Acoustics Insider - Terms and Conditions
1. Agreement Scope and Parties
1.1 These Terms and Conditions ("Terms") constitute a legally binding B2B agreement between Acoustics Insider ("Company", "we", "us") and professional clients ("Client", "you") purchasing our courses and consulting services.
1.2 By purchasing our services, you confirm that you are acquiring them for business purposes as a professional in the music, audio production, or related industries. These Terms explicitly exclude consumer protection rights.
2. Services
2.1 Our services include online courses, consulting, and related educational materials focused on studio acoustics and audio production ("Services").
3. Payment Terms
3.1 All prices are listed in USD or EUR and include applicable taxes or duties.
3.2 We accept payment via major credit cards and PayPal through our secure payment processors.
4. Intellectual Property Rights
4.1 All course materials, including but not limited to videos, documents, diagrams, and methodologies, remain the exclusive property of Acoustics Insider.
4.2 Upon payment, you receive a non-exclusive, non-transferable license to use the materials for your business purposes only.
4.3 You may not:
- Share, resell, or distribute any course materials
- Record, copy, or reproduce any content
- Remove any copyright or proprietary notices
- Use materials for competing business purposes
5. Refund Policy
5.1 Online Courses:
- 60-day "no questions asked" refund policy
5.2 Consulting Services:
- Full refund available within first month after initial call if you're not satisfied with our working relationship, no questions asked
- 50% refund available after the first month and within three months of initial call if you're not satisfied with our working relationship, no questions asked
6. Limitation of Liability
6.1 Our total liability under these Terms shall not exceed the amount paid for the Services.
6.2 We are not liable for:
- Implementation results or business outcomes
- Indirect, consequential, or incidental damages
- Lost profits or business opportunities
- Technical issues beyond our reasonable control
7. Warranties and Disclaimers
7.1 We warrant that:
- Services will be provided with reasonable skill and care
- Materials are our original work or properly licensed
7.2 We do not guarantee:
- Specific business results or outcomes
- Compatibility with all systems/equipment
- Uninterrupted access to online materials
8. Term and Termination
8.1 We reserve the right to terminate access to Services for:
- Violation of these Terms
- Fraudulent activity
- Non-payment
- Sharing of access credentials
9. Confidentiality
9.1 Both parties agree to maintain the confidentiality of any proprietary information shared during the provision of Services.
10. Governing Law and Dispute Resolution
10.1 These Terms are governed by the laws of the Federal Republic of Germany.
10.2 Any disputes shall be resolved through:
Good faith negotiation
Mediation
Binding arbitration as a last resort
10.3 The place of jurisdiction for all disputes arising from this agreement is Berlin, Germany.
11. Modifications
11.1 We reserve the right to modify these Terms at any time, with notice provided through our website or email.
